Bair, LLC (the “Firm,” “we,” “us,” or “our”) collects, uses, and shares information in connection with the website located at brianbair.law (the “Website”). By using the Website, you agree to the practices described in this Policy. Your use of the Website is also subject to our Terms of Use and Disclaimer.
This Privacy Policy describes, among other things, the types of information we collect when you visit the Website, how that information may be used and when it may be disclosed, how you can control its use and disclosure, and how it is protected.
By using the Website and the services offered through it, you consent to this Privacy Policy, our Terms of Use, and our Disclaimer. We may change this Privacy Policy at any time; please refer to the section entitled “Changes to This Policy” below. 1. Scope of This Policy
This Policy applies to information we collect about you in connection with your access to and use of the Website. It does not apply to information you provide to the Firm in connection with an attorney–client relationship or a separate written engagement agreement, which is governed by that agreement, by our professional obligations of confidentiality, and by applicable rules of professional conduct rather than by this Policy.
2. Information We Collect
Information you provide. When you submit an intake form or otherwise contact us through the Website, we collect the information you choose to provide. Depending on the form, this may include your name and contact details (such as email address and telephone number), information such as citizenship or domicile where relevant to your matter, business or ownership information, details about the trademark or copyright matter you are inquiring about, and any files you choose to upload (such as specimen images or audio files).
Information collected automatically. When you visit the Website, our hosting and security provider may automatically collect limited technical information, such as your IP address, browser type, device information, and the date and time of your visit, for the purposes of operating, securing, and maintaining the Website. We also use a privacy- focused, cookieless analytics service that measures aggregate usage of the Website without identifying you individually.
Newsletter sign-up. If you subscribe to our newsletter, we collect your name and email address for the purpose of sending you informational updates about the firm, such as new blog posts and firm news. This information is transmitted over encrypted connections and stored with our email service provider, Resend, which processes it on our behalf. Newsletter emails are standard email messages and are not end-to-end encrypted. The newsletter is informational only; please do not send confidential or time-sensitive information in reply to a newsletter, and do not include confidential information when subscribing. Subscribing to the newsletter does not create an attorney–client relationship. You may unsubscribe at any time using the link included in every newsletter email or by contacting us at contact@brianbair.law, and we will remove your information from the subscriber list.
3. How We Use Your Information
We use the information we collect to:
- Respond to your inquiries and requests;
- Evaluate and, where appropriate, undertake a prospective engagement;
- Perform conflict-of-interest checks;
- Operate, maintain, and secure the Website;
- Communicate with you, including responding to your requests or inquiries;
- Prevent, investigate, identify, or take other action regarding any suspected or actual fraudulent or illegal activity or other activity that violates the Firm's policies;
- Comply with applicable laws, rules, regulations, and legal process, as well as the Firm's policies;

We do not:
- Sell or rent your personal information;
- Use your information for targeted marketing or advertising;
- Build individual profiles of you or track you across other websites; or
- Tailor our services or content to you as an individual.
The cookieless analytics described below measure aggregate, non-identifying usage of the Website and do not single you out individually.
4. How We Share Your Information
We do not sell or rent your personal information. We share information only with service providers that help us operate the Website and communicate with you, and only as needed for those purposes:
- Cloudflare — hosts the Website, provides edge security, executes the form-handling function, and provides cookieless analytics.
- Resend — delivers your form submission to us by email as a transactional message.
We may also disclose information:
- If required to do so by law, law enforcement, rule, regulation, or other legal process, or in response to a governmental request;
- If necessary to prevent or detect fraud or other violations of the law or our policies;
- If necessary to protect the rights, property, life, health, and safety of the Firm, its members, or others;
- In connection with any proposed or actual business transaction—including financing, merger, purchase, sale, dissolution, or other acquisition or transfer of all or a portion of our assets or practice—in which case information may be transferred as part of that transaction consistent with applicable rules of professional conduct;
- With your consent or at your direction;
- For any purpose disclosed at the time you provide your information; and
- For any other purpose consistent with this Policy or otherwise permitted by applicable law.
5. Cookies and Analytics
We do not use advertising or cross-site tracking cookies. Our analytics provider is cookieless and does not build individual profiles or track you across other websites. Your browser may store certain preferences (such as a light or dark display setting) locally on your device; this information stays in your browser and is not transmitted to us.
Do Not Track. Your web browser may have settings that allow you to transmit a “Do Not Track” signal when you visit websites or use online services. 6. Email Communications
When you submit a form or email us, your message is delivered to our email inbox, and we may use your contact information to respond. As noted in our Disclaimer and Terms of Use, contacting us does not create an attorney–client relationship, and information you send before a written engagement agreement is in place may not be treated as confidential or privileged. Please do not send sensitive or confidential information through the Website until we have confirmed that doing so is appropriate.
If you subscribe to our newsletter or otherwise opt in to receive email updates, you can unsubscribe at any time by following the unsubscribe instructions in those emails or by contacting us at contact@brianbair.law. Your opt-out is limited to the email address used and will not affect other subscriptions. Even if you opt out of marketing emails, we may continue to send you non-marketing communications, such as messages about a matter you have engaged us for, information you have specifically requested, or our professional relationship with you.
7. Data Security
We take reasonable measures to protect the information you submit. Information is transmitted over an encrypted (HTTPS) connection, your form submission is delivered to us by email rather than stored on the Website's servers, and our email mailbox is encrypted at rest. In addition, information you submit through our intake and contact forms is encrypted in your browser before it is transmitted, so that our service providers handle only encrypted content that they cannot read. However, no method of transmission or storage over the internet is completely secure, and the Firm cannot guarantee absolute security of your personal information collected through the Website.
8. Data Retention
We retain the information you submit for as long as necessary to respond to your inquiry, to evaluate or carry out a potential or actual engagement, and to satisfy our recordkeeping, legal, and professional-responsibility obligations, after which we dispose of it in accordance with our records practices.
9. Links to Other Websites
The Website includes links to websites operated by others, which may include links to client products or services and to our profiles on social-media platforms. When you follow these links, the operators of those websites and platforms may independently collect information about you and may use their own cookies and tracking technologies. This Policy does not apply to those websites or platforms, which have their own privacy policies that we encourage you to review. We are not responsible for the content or privacy practices of any website or platform we do not control.
We may maintain profiles on social-media platforms and link to them from the Website. If you interact with us on those platforms, the platform may share information with us in accordance with its own settings and policies. We do not embed social-media tracking widgets on the Website.
10. Visitors from Outside the United States
The Website is operated in the United States, is governed by U.S. law, and is intended for users located in the United States. If you access the Website from outside the United States, you understand that the information you provide will be transferred to, processed, and stored in the United States, where data-protection laws may differ from those in your jurisdiction. By submitting your personal information through the Website, you acknowledge that it will be processed in the United States in accordance with this Policy. 11. California and Nevada Residents
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We will not discriminate against you for exercising any such rights.

The Website is intended for adults and is not directed to children. We do not knowingly collect personal information from anyone under the age of thirteen (13). If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it in accordance with applicable law.
